1. About These Terms
These Terms and Conditions govern use of the Dashe mobile application and services, operated by Greenleaf TDG, registered in the United Kingdom. By creating an account or using the Service, you agree to be bound by these Terms, the Privacy Policy, and Cookie Policy. We may update these Terms periodically, with material changes communicated via the app or email. Continued use indicates acceptance of updates.
2. Eligibility
Users must be at least 16 years old, have legal capacity to enter binding agreements, and provide accurate information during registration. Those using the Service on behalf of organisations confirm they have authority to bind that organisation to these Terms.
3. The Service
Dashe automatically detects and records journeys using GPS and activity recognition, classifies transport modes, calculates carbon emissions, enables organisational membership, provides car-sharing features, and allows logging of work schedules. For organisations, Dashe also provides a business platform of web dashboards, system integrations and carbon reporting, accessed under a Business Subscription (Section 4.2). We reserve the right to modify, suspend, or discontinue any Service component with or without notice, using reasonable efforts to notify you of significant changes.
4. Pricing and Subscriptions
4.1 Individual Users. The Dashe mobile app is free to download and use for individuals, with no charges for journey tracking or emission calculations.
4.2 Business Subscriptions. Organisations accessing the web application, reporting dashboards, and organisational features must purchase a paid subscription based on headcount and site count, subject to a separate subscription agreement.
4.3 Subscription Terms. Billing follows the subscription agreement, with fees quoted exclusive of VAT. Payment must be received by the due date, with suspension possible if payment is 30+ days overdue. We may change pricing with 30 days' written notice before the next billing period. Either party may cancel according to the subscription agreement terms; upon cancellation, organisational access ends at the conclusion of the current billing period. Subscription fees are non-refundable except as required by law or written agreement. Cancellation does not affect individual user accounts or data, which may continue using the free mobile app.
5. Your Account
5.1 Account Creation. Users must create an account and agree to provide accurate, current, and complete information during registration, keeping account details up to date.
5.2 Account Security. Users are responsible for maintaining credential confidentiality and must immediately notify [email protected] of unauthorised account access. We are not liable for losses arising from a failure to protect credentials.
5.3 One Account Per Person. Each person may maintain only one account. We reserve the right to suspend or terminate duplicate accounts.
6. Permissions and Device Access
The Dashe app requires access to specific device features:
| Permission | Why It Is Needed | Required |
|---|---|---|
| Location (Always / Background) | Automatic journey detection and tracking, even when the app is not in the foreground | Yes (core functionality) |
| Activity Recognition | Detecting your mode of transport (walking, driving, cycling, etc.) | Yes (core functionality) |
| Motion and Pedometer | Supporting transport mode classification and step counting | Yes (core functionality) |
| Notifications | Alerting you about journey updates, organisation invitations, and service messages | Optional |
You may revoke these permissions through your device settings at any time, though revoking required permissions prevents core features from functioning.
7. Acceptable Use
Users agree to use the Service lawfully and in accordance with these Terms. Prohibited activities include: unlawful purposes or violation of applicable law; unauthorised access attempts; interference with Service integrity; reverse engineering or decompilation; use of automated scripts or bots without consent; submitting false or misleading information; impersonation or misrepresentation; collecting personal data of other users without consent; and publicly sharing car share codes to manipulate emission data. We reserve the right to suspend or terminate accounts for breaching these Terms.
8. Organisations
When joining an organisation within Dashe, certain journey and emission data may be shared with organisational administrators for corporate carbon reporting as described in the Privacy Policy. Organisations may set policies affecting journey categorisation. Users may leave organisations at any time; data already shared in aggregated form may not be retrievable. Organisation administrators are responsible for their own data use and must comply with applicable data protection laws.
9. Car Sharing
The car sharing feature allows multiple Dashe users to link journeys and split carbon emissions among occupants. Users are responsible for sharing car share session codes only with intended participants. Emission calculations are based on participant counts and vehicle details provided. We are not responsible for inaccurate emission splits caused by incorrect participant counts or users failing to join or leave sessions.
10. Vehicle Data and DVLA Lookups
The Service allows vehicle registration using registration numbers, with publicly available vehicle information looked up from DVLA data. Users confirm they are the registered keeper or have the keeper's permission. Vehicle data is used solely for carbon calculations and registration numbers are not shared with third parties except as necessary for lookups. We do not guarantee external data accuracy; users should contact support if data appears incorrect.
11. Accuracy of Data and Emissions
Dashe uses GPS, activity recognition, and vehicle data to estimate carbon emissions. While we strive for accuracy, users acknowledge that emission calculations are estimates, not precise scientific measurements. GPS accuracy is affected by environmental factors, device hardware, and battery-saving settings. Automatic transport mode detection may occasionally misclassify travel modes, correctable manually within the app. Emission factors are based on published averages and may not reflect specific vehicle emissions under specific driving conditions. We periodically update emission factors and calculation methods, which may change historical data. Users should not rely solely on Dashe data for regulatory reporting, legal compliance, or certified emission measurements.
12. Intellectual Property
12.1 Our Rights. All intellectual property rights in the Service, including the app, design, functionality, branding, logos, and content, are owned by Greenleaf TDG or its licensors. These Terms grant no rights to intellectual property except the limited licence described below.
12.2 Your Licence. Subject to these Terms, we grant a limited, non-exclusive, non-transferable, revocable licence to download, install, and use the Dashe app on personal devices for personal or organisational use. This licence does not allow copying, modifying, or distributing the app; sublicensing, selling, leasing, or renting the app or access to it; or using the app for commercial purposes other than tracking personal or organisational carbon emissions.
12.3 Your Data. Users retain ownership of personal data provided to the Service. By using it, users grant us a licence to process that data as described in the Privacy Policy for providing and improving the Service.
13. Limitation of Liability
Nothing in these Terms excludes liability for death or personal injury from negligence, fraud or fraudulent misrepresentation, or any liability that cannot be excluded under English law.
Subject to the above and to the fullest extent permitted by law:
- The Service is provided on an "as is" and "as available" basis with no guarantee of uninterrupted, error-free, or virus-free operation.
- We are not liable for indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, business opportunity, or goodwill.
- We are not liable for losses arising from inaccurate emission calculations, GPS errors, or transport mode misclassification.
- We are not liable for losses arising from actions taken by organisations based on shared data.
- Our total aggregate liability is capped at: (a) for individual free app users, £100; or (b) for organisations with Business Subscriptions, the total subscription fees paid in the preceding 12 months.
14. Indemnity
Users agree to indemnify and hold harmless Greenleaf TDG, its directors, employees, and agents from claims, liabilities, damages, losses, or expenses arising from Service use in breach of these Terms; violation of applicable law; false or inaccurate information provided; or infringement of third-party rights.
15. Suspension and Termination
15.1 By You. Users may stop using the Service and delete their account at any time through the app or by contacting [email protected]. Upon deletion, data is handled as described in the Privacy Policy.
15.2 By Us. We may suspend or terminate access if users breach these Terms, we are required to by law, an account is reasonably believed compromised, or we decide to discontinue the Service (providing reasonable notice).
15.3 Effect of Termination. Upon termination, the licence to use the Service ends immediately. Sections that by their nature should survive (Limitation of Liability, Indemnity, Governing Law) continue to apply.
16. Third-Party Services
The Service relies on Firebase Authentication for account management, Google Maps for map rendering, and AWS for infrastructure and storage. We are not responsible for third-party service availability, accuracy, or performance. Third-party service use is subject to their own terms and conditions. Outages or changes may affect Service availability or functionality.
17. App Store Terms
Downloading Dashe from the Apple App Store or Google Play Store means also agreeing to their terms of service. These Terms take precedence in conflicts. Users acknowledge these Terms are between them and Greenleaf TDG, not the app store providers, which have no maintenance or support obligations.
18. Consumer Rights
For consumers (individuals acting outside trade, business, craft, or profession), nothing in these Terms affects statutory rights under the Consumer Rights Act 2015, the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, or other consumer protection legislation. If any provision is found unfair under the Consumer Rights Act 2015, it will not bind consumers, but the remainder of these Terms continues to apply.
19. Governing Law and Disputes
These Terms are governed by the laws of England and Wales. Consumers may bring legal proceedings in the courts of their UK residence. Businesses are subject to the exclusive jurisdiction of the courts of England and Wales. We encourage you to contact [email protected] to resolve disputes informally before legal action.
20. General
20.1 Entire Agreement. These Terms, together with the Privacy Policy and Cookie Policy, constitute the entire agreement regarding Service use, superseding all prior agreements, representations, and understandings.
20.2 Severability. If any provision is found invalid or unenforceable by a competent court, it will be enforced to the maximum extent possible, with the remaining provisions remaining in full force and effect.
20.3 Waiver. Failure to enforce any right or provision does not constitute a waiver. Any waiver must be in writing and signed by Greenleaf TDG.
20.4 Assignment. Users may not assign or transfer rights or obligations without prior written consent. We may assign our rights and obligations (for example, in mergers or acquisitions) and will notify users.
20.5 Force Majeure. We shall not be liable for delays or performance failures arising from events beyond our reasonable control, including natural disasters, pandemics, strikes, government actions, power failures, or internet outages.
